The Brazilian Senate is set to vote on a bill regulating artificial intelligence (AI) this Thursday. Proposed by Senator Rodrigo Pacheco, the legislation aims to create a robust legal framework for digital technologies and media, ensuring legal security in this field.
The initiative seeks to define the limits of AI usage, outlining necessary permissions and establishing a series of prohibitions, sanctions, and exceptions within a regulatory system.
Prohibited actions for AI platform providers will be specified, while allowed uses include real-time remote biometric identification for capturing fugitives and gathering evidence in police investigations with judicial authorization.
The law will impose penalties, including fines up to 50 million reais (approximately $8.34 million) or 2% of a company's revenue for violations. It will also permit high-risk procedures, such as assessing the credibility of evidence in criminal investigations.
A regulatory body, the National System for AI Regulation and Governance (SIA), will be established, coordinated by the National Data Protection Authority (ANPD), to oversee high-risk procedures that could adversely affect citizens' rights and freedoms.
If approved, the bill will proceed to the Chamber of Deputies for further consideration.
