Governor Gavin Newsom and Attorney General Rob Bonta, both Democrats, allege that the International Emergency Economic Powers Act of 1977 does not grant the president the authority to impose sweeping tariffs without congressional consent by declaring a state of emergency unreasonably. California, a major economic power with significant trade ties to China, Mexico, and Canada, claims it has already suffered and will continue to suffer if the tariffs remain.
The lawsuit seeks to prevent the Department of Homeland Security and Customs and Border Protection from enforcing the tariffs. The Trump administration faces similar lawsuits from the Liberty Justice Center and a small business owner. These lawsuits challenge the legality of the tariffs imposed on various countries, including China.
